====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-12-2020 Heard Mrs. Shruti Sinha, learned counsel for the petitioners and the learned Additional P.P. through video conferencing.

The petitioners apprehend their arrest in Durgawati P.S. Case No.79 of 2020, registered under Sections 302/34/120(B) of the Indian Penal Code.

The informant alleged that he married his daughter to Jelar Singh @ Chhotu 8 years ago. After sometime, Jelar Singh developed illicit relation with the wife of Hiru Singh @ Krishna Deo Singh, his elder brother. The daughter of the informant was objecting but the accused persons were torturing her. It is further alleged that Suman Devi, the wife of petitioner no.1 wanted that

Patna High Court CR. MISC. No.30432 of 2020(2) dt.16-12-2020 2/3 the deceased should not give birth to a child. On 15.03.2020, Hiru Singh, petitioner no.1 informed the informant that his daughter was ill. When the informant came, he found his daughter lying dead.

Learned counsel for the petitioners submits that the petitioners are brother-in-law and sister-in-law of the deceased. The marriage was solemnized 8 years ago and they have no manner of concern with the family affairs of the deceased and her husband. The deceased was not able to give birth to a child and that is why she herself committed suicide. The informant made allegation that the husband of the deceased developed illicit relation with petitioner no.2, which is false and concocted.

Taking into consideration the facts and nature of allegations made against the petitioners and the fact that the deceased was married to Jelar Singh 8 years ago and thereafter his wife was killed and petitioners are elder brother and wife of elder brother of the husband of the deceased, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.
