Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application for regular bail arises out of Guthni P.S. Case No. 63 of 2021, disclosing offence punishable under Sections 392/414/34 of the Indian Penal Code. The petitioner is in custody since 17.03.2021. The allegation in the FIR is of snatching of a motorcycle by unknown miscreants at the point of dagger.
Learned Senior Counsel appearing on behalf of the petitioner has submitted that he has been implicated in this case
Patna High Court CR. MISC. No.41273 of 2021(3) dt.06-01-2022 2/2 only on the basis of confessional statement of a co-accused. He further submits that the petitioner's implication is because of his implication in other three cases that too on the basis of confessional statements of co-accused of those cases. Be that as it may, considering the nature of accusation and the fact that petitioner is in custody since 17.03.2021, a case for grant of regular bail is made out. This application is accordingly allowed.
Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned C.J.M., Siwan in Guthni P.S. Case No. 63 of 2021. (Chakradhari Sharan Singh, J) Rajesh/- U T
