The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307 and other sections of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that the thirteen named accused persons including the petitioner herein as also 7-8 unknown accused raised halla that the informant and others had stolen the buffaloes. The accused persons assaulted the informant and his friend as a result of which Rupesh Kumar died.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioner is

Patna High Court CR. MISC. No.31065 of 2022(2) dt.13-01-2023 2/2 in custody since 16.1.2022 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation in the F.I.R., the petitioner having remained in custody for about 1 year since 16.1.2022 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sonbarsa Raj P.S. Case no.153 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Saharsa.
