In this case, the petitioner is apprehending his arrest in connection with Trial No. 2653 of 2018, G.R. Case No.1034 of 2017 arising out of Ghorasahan P.S. Case No. 402 of 2017 registered for offences under sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. An allegation has been made against the petitiner that on 30.7.2017 at about 4 O'clock in the evening, the petitioner along with co-accused persons, namely, Daya Shankar Sah, Rameshwar Sah, Mantu Sah, Prince Kumar, Ramadhar Sah, Ramjivan Sah, Mohan Sah, Siya Ram Sah and Prem Sah armed with deadly weapons came at the house of the Informant and asked to remove the thatched hut and started to assault the

Allegation has been made against different persons but, there is no specific allegation against the present petitioners.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Sri Bhagwan Sah, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran in connection with Trial No. 2653 of 2018 (G.R. No. 1034 of 2017) arising out of Ghora Sahan P.S. Case No. 402 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
