Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code.

Allegation is that the accused persons assaulted the son of the informant by means of iron rod, as a result of his son fell down and thereafter with a view to vanish evidence Loha Singh wanted to crash the head of his son by wheel of tractor. He was taken to Hospital for treatment, where doctor declared him dead.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.2.2019 and has got no

There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. After investigation, charge sheet has been submitted under Sections 304(A) of I.P.C. along with other allied Sections. It is a case of accident.

On behalf of the State and learned counsel for the informant it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S. case No.54 of 2019.
