This application is filed for grant of regular bail in connection with Special Case No.3190 of 2023 arising out of Shastri Nagar P.S. Case No. 337 of 2023 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. Learned counsel for the petitioner submits that there is recovery of 149.85 litres illegal English Wine. The petitioner is in custody since 03.04.2023 and he has six criminal antecedents.
Patna High Court CR. MISC. No.34428 of 2023(2) dt.24-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna, in connection with Special Case No.3190 of 2023 arising out of Shastri Nagar P.S. Case No. 337 of 2023.
The petitioner will visit Shastri Nagar police station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
