The petitioner has renewed his prayer for bail in connection with Durgawati P.S. Case No.58 of 2020 registered for the offences punishable under Sections 467, 468, 469, 471, 420, 120-B of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. His prayer for bail was earlier rejected by this Court vide order dated 18.09.2020 passed in Cr. Misc. No.23332 of 2020. The petitioner is alleged to have been intercepted by the police while he was carrying 6000 liters of illicit liquor kept in 702 cartons in a specially designed secret chamber of the truck bearing Registration No.UP-12AT-0225.

Learned counsel for the petitioner submitted that

Learned counsel for the State opposed the prayer for bail.

Considering the nature of the offence, the period of about two and a half years undergone by the petitioner as an under-trial prisoner and the stage of the case, I am inclined to grant him bail. He is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Kaimur at Bhabhua in connection with Durgawati P.S.
