====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-07-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioners as well as learned APP for the State.

At the outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition in respect of petitioner Nos. 1 and 4 as they have been arrested during pendency of the bail petition.

Patna High Court CR. MISC. No.31830 of 2022(2) dt.27-07-2022 2/3 In view of the aforesaid submission, the anticipatory bail petition in respect of petitioner Nos. 1 and 4 is dismissed as withdrawn.

The petitioner Nos. 2 and 3 apprehend their arrest in connection with Sultanganj P.S. Case No. 230 of 2021, registered for the offences punishable under Sections 452, 147, 149, 341, 323, 379, 354, 308, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that the specific allegation against petitioner No. 1, Vishnu Manjhi, and co-accused Shankar Manjhi is of inflicting lathi blow on the head of the informant and petitioner No. 4 outraged the modesty of informant's wife. So far as petitioner Nos. 2 and 3 are concerned the allegation against them is general and omnibus and they are the persons of clean antecedents. Considering the above-mentioned facts and circumstances, let the petitioner Nos. 2 and 3, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bhagalpur in connection with Sultanganj P.S. Case No. 230 of

Patna High Court CR. MISC. No.31830 of 2022(2) dt.27-07-2022 3/3 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
