2. The petitioner is in custody in connection with N.T.P.C. P.S. Case No. 65 of 2023 for the offence punishable under Sections 341, 323, 307, 324, 326, 379, 504, 506 and 34 of the Indian Penal Code lodged on 28.04.2023 by the informant, Awadhesh Singh.
3. As per the prosecution story, the informant alleged that while he was irrigating his maze field, the accused persons came, armed variously, demanded extortion and upon protest, this petitioner gave iron rod blow on the head causing injuries. There is further allegation of snatching of gold chain etc. Accordingly, the FIR.
4. Learned counsel for the petitioner submits that he
Patna High Court CR. MISC. No.32137 of 2025(2) dt.16-05-2025 2/3 do not have criminal antecedent, has already suffered by being in custody for a year (since 08.05.2024) and shall be diligently appearing in trial.
5. Learned APP, Mr. Bharat Bhushan opposes the prayer for bail submitting that allegation of assault is on this petitioner.
6. Taking into account the submission of the parties as also that earlier the bail application was rejected in Cr. Misc. No. 52391 of 2024, now the second bail application has come. The petitioner do not have criminal history has remained in custody for more than a year and undertaking has been given that he shall be diligently appearing in trial, in that background, this Court is inclined to extend him the privilege of bail with conditions.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned ADJ-IV, Barh, Patna in connection with N.T.P.C. P.S. Case No. 65 of 2023 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
Patna High Court CR. MISC. No.32137 of 2025(2) dt.16-05-2025 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every fortnight for six months to mark his attendance;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
