"(i) That by the present writ application the petitioners challenges the validity, legality and propriety of the clause 9 (1) (iii) (Kh) of the notification vide notification no. 2416 dt. 11/05/2015 issued under signature of Sri Dipak Kumar Singh, Secretary to Govt., by order Governor of Bihar by which Bihar Water Resources Department Subordinate Engineering (Mechanical) Cadre Recruitment Rule-2015 has been approved for appointment of Junior Engineer (Mechanical), in Bihar water Resources Department Subordinate Engineering (Mechanical ) Cadre Services by which Distance Mode Diploma in Mechanical has been

(ii) To issue an appropriate writ /orders MANDMUS directing the respondents authorities to modify the word "non distance mode Diploma in mechanical" to "Diploma in Mechanical" of the clause 9 (1) (iii) (Kh) of the notification vide notification no. 2416 dt. 11/05/2015 issued under signature of Sri Dipak Kumar Singh, Secretary to Govt., by order Governor of Bihar by which Rule and regulation has been framed for appointment of Junior Engineer (Mechanical), in Bihar water Resources Department Subordinate Engineering (Mechanical) Cadre Recruitment Rule- 2015.

(iii) To issue an appropriate writ /orders MANDMUS directing the respondents authorities to allow the candidates for appointment to those candidates who have obtained Diploma in mechanical from Distance Mode from Deemed University recognized by UGC and AICTE.

(iv) To any other relief (S) for which petitioners are entitled for in the facts and circumstances of the case."

2. It is submitted by learned counsel for the petitioners that the matter having become infructuous, he seeks permission to withdraw the application.

3. In view of the above, the application is dismissed as withdrawn.
