The petitioner seeks bail in Patna Junction P.S. Case No. 150 of 2020 (G.R. No. 139 of 2020), registered for the offence under Section 363 of the Indian Penal Code. It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. In this case, statement of the victim boy (Lal Bahadur Kumar) has been recorded under Section 164 Cr.P.C. (Annexure - 2) wherein he has clearly stated that no one has kidnapped him. Petitioner has got clean antecedent and he is in custody since 08.03.2021. In view of statement of the victim recorded under Section 164 Cr.P.C., the bail petition of petitioner is allowed.
