This is the second attempt on behalf of the petitioner for grant of bail in connection with Mohanpur P.S. Case No.109 of 2024 registered for the offence under sections 304-B/34 of the Indian Penal Code.

The petitioner is the husband of the deceased. He is said to have killed his wife. 4.

The petitioner is in custody since 10.07.2024.

Learned counsel for the petitioner has submitted that in the case diary it has come that the deceased had committed suicide and even the independent witnesses have clearly stated that the deceased had committed suicide. He has further submitted that in the trial out of eight witnesses only

Considering the fact that the case diary indicates that the deceased had committed suicide, the period of custody of the petitioner, which is from 10.07.2024 and also the delay in trial, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge, 1st Sherghati, Gayaji / concerned Court below, in connection with Mohanpur P.S. Case No.109 of 2024, subject to the condition that he will cooperate in the trial and will appear personally or through his advocate on the dates fixed in the trial.

It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
