Petitioner is apprehending arrest in connection with Bithan P.S. Case No. 86 of 2011 for the offence under section 409 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
In the instant case the allegation against this petitioner and Ashok Kumar Panjiar is of misappropriation of grains supplied under Sampurn Gramin Rojgar Yojana.
Learned counsel appearing on behalf of the petitioner has drawn attention of this court in the order passed by a coordinate Bench of this Court in Cr. Misc. No. 34387 of 2013 dated 09.10.2013 whereby co-accused Ashok Kumar Panjiar
Patna High Court Cr.Misc. No.56526 of 2018(2) dt.08-10-2018 2/2 has been granted anticipatory bail by this Court. Considering the fact that allegation against this petitioner and Ashok Kumar Panjiar is identical, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Rosera, Samastipur, in connection with Bithan P.S. Case No. 86 of 2011 subject to the condition as laid down under section 438(2) of the Cr.P.C.
