The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Vaishali (Belsar OP) P.S.Case No.20 of 2020, registered under section 30(a) of Bihar Prohibition and Excise Act, 2016. As per allegation in the F.I.R., 1226.16 litres of liquor is stated to have been recovered from a pick-up van standing in front of the house of the petitioner.

It is submitted by learned counsel for the petitioner that he has no criminal antecedent and has no concern either with the seized article or with the vehicle from which it is stated to have been recovered.

The application for bail is opposed by the learned APP

Patna High Court CR. MISC. No.30591 of 2020(2) dt.22-01-2021 2/2 for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the fact of the petitioner having no criminal antecedent, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of six weeks from today and in the event of his arrest or surrender in connection with Vaishali (Belsar O.P.) P.S.Case No.20 of 2020, he will be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Excise, Vaishali at Hajipur, subject to the conditions as laid down under section 438(2) of Code of Criminal Procedure.
