Petitioner seeks regular bail in a case registered for the offence punishable under Section 379, 414 and some other ancillary Sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons were apprehended with stolen tractortrailor, one solar plate and 56 batteries. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner is in custody

Patna High Court CR. MISC. No.41098 of 2021(2) dt.17-01-2022 2/2 since 28.02.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Mritunjay Singh, Judicial Magistrate, 1st class, Bettiah, West Champaran in connection with Srinagar (Pujaha) PS case No.25/2021.
