2. The petitioner seeks bail in connection with Bidupur P.S. Case No. 625 of 2025 instituted for the offences under Sections 140(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Prosecution case, in short, is that the accused persons allegedly kidnapped the informant's 4-year-old son and demanded 10,000/- as ransom, leading to the registration of ₹ the present case.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. The name of the petitioner has transpired in this case on the basis of mobile number which was used in the alleged demand of

Learned counsel further submitted that the petitioner's mobile was misused by someone else for the alleged demand of ransom and this petitioner never demanded any ransom from the informant nor he kidnapped the informant's son. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. There is no eyewitness to the alleged occurrence. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.10.2025 and has no criminal antecedent.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner stating that the accused persons kidnapped the minor son of the informant and demanded a ransom of Rs. 10,000/-. He further submitted that the informant's son is still traceless. Learned counsel further contended that the active involvement of the petitioner in the alleged occurrence is established from the mobile phone which was used for demanding ransom which belongs to the petitioner along with CDR report. Learned APP, therefore, submitted that petitioner does not deserve to be released on bail.

6. Considering the aforesaid facts and circumstances of the case, victim still being traceless as also there being ample

Patna High Court CR. MISC. No.31602 of 2026(4) dt.22-07-2026 3/3 material against the petitioner to show the involvement of the petitioner in the kidnapping of the informant's son, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
