JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-05-2019 It appears that in paragraph 3 of order dated 29.04.2019, there is innocent error, as instead of M.J.C. No. 4092 of 2012, it was wrongly typed as 409 of 2012. Ref.: I.A. No. 2 of 2019 Mr. Anand Kumar Ojha, learned counsel appearing on behalf of the petitioner has drawn the attention of the Court to I.A. No. 2 of 2019, which was not taken note by the Court while passing the order dated 29.04.2019.

I.A. No. 2 of 2019 was filed for substitution of the petitioner, namely, Ranvijay Singh @ Ranvijay Pd. Singh, who died during the pendency of the writ application, but instead of taking note of I.A. No. 2 of 2019, the Court has passed the order dated 29.04.2019.

Considering the aforesaid, the I.A. No. 2 of 2019 is allowed and order dated 29.04.2019 stands modified to the

Patna High Court CWJC No.8773 of 2015(5) dt.15-05-2019 2/2 extent that the name of original petitioner, namely, Ranvijay Singh @ Ranvijay Pd. Singh, be expunged and in his place his legal heirs mentioned in para 3 of I.A. No. 2 of 2019 be substituted as petitioners in the instant case. In view of the above, wherever the name of Ranvijay Singh @ Ranvijay Pd. Singh (original petitioner) is mentioned in the order dated 29.04.2019, the same may be read as legal heirs of Ranvijay Singh @ Ranvijay Pd. Singh. Office is directed to make necessary correction in the array of petitioner.

The order dated 29.04.2019 is modified to the extent mentioned above.
