In this case, the petitioners are apprehending their arrest in connection with Jagdishpur P.S. Case No. 204 of 2018 registered for offences under sections 302, 201/34 of the Indian Penal Code.
An allegation has been made against the petitioners to have killed the victim but, the order of the Sessions Judge itself shows that it is a case of suicide of deceased mother and daughter on account of some dispute.
Learned counsel for the petitioners submits that the petitioners are father-in-law and brother-in-law respectively having no connection with the husband of the victim lady and the police have submitted the charge-sheet against the husband
Patna High Court Cr.Misc. No.56320 of 2018(2) dt.20-09-2018 2/2 of the deceased not against the present petitioners. Looking to the entire facts and circumstances of the case, let the petitioners, namely, Shiv Prashanna Ram and Gorakh Ram, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additinal Chief Judicial Magistrate-XI, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 204 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
