JUSTICE ANIL KUMAR SINHA ORAL ORDER 29-01-2022 Heard Mr. Gagan Deo Yadav, learned counsel for the petitioner and Mr. Rajendra Singh, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Andhramath P.S. Case No. 136/2020 registered for the offence punishable under Section 392 of the Indian Penal Code 1860. As per the First Information Report, while the informant was going on his Motorcycle, he was accosted by three unknown miscreants who snatched the Motorcycle, Rs.4,500/- cash, Aadhar Card, Voter Identity Card etc. from the informant.
Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and he

No.41144 of 2021(2) dt.29-01-2022 2/3 has been implicated in this case on the basis of confessional statement made by the co-accused Sanjiv Kumar Sah who has been granted bail by this Court in Cr. Misc. 15020 of 2021. Learned counsel further submits that no looted article has been recovered from possession of the petitioner and the petitioner has not been put on Test Identification Parade by the Police as yet. The petitioner is in custody since 2.11.2020, charge sheet has already been submitted and the trial is not likely to be concluded in near future due to Covid-19 pandemic.
Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, no looted article has been recovered from his possession, his name transpired on the basis of confessional statement of Sanjiv Kumar Sah and he has been granted bail by this Court, the charge sheet has already been submitted and the petitioner is in custody since 2.11.2020, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class,
Patna High Court CR. MISC. No.41144 of 2021(2) dt.29-01-2022 3/3 Jhanjharpur, Distt. Madhubani, in connection with Andhramath P.S. Case No. 136/2020.
It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
