Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Darihat P.S. Case No. 56 of 2020 registered for offence punishable under sections 147, 148, 341, 323, 327, 307, 504, 506, 379 of the Indian Penal Code.

As per allegation, when the informant was taking meals, three named accused persons, including the petitioner were assaulting his son Ramashish Kumar. They also assaulted Chana Devi. Co-accused Sonu Kumar assaulted the informant

The learned counsel for the petitioner has submitted that there is case and counter case. The petitioner is a person of clean antecedent and injuries found on the persons of Chana Devi and Ramashish Kumar are simple in nature. The learned APP has opposed the prayer for bail. Considering the above-mentioned facts and circumstances, specially the clean antecedent of the petitioner, let him, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Dehri-OnSone, Rohtas in connection with Darihat P.S. Case No. 56 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
