JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of para 39 of the case diary, it appears that after two months of the alleged occurrence, petitioner was caught along with one Sujeet Kumar, while they were going on a Tata Safari vehicle and it is stated that petitioner disclosed that F.I.R named accused namely, Raju Rai fled away from the vehicle, seeing the police. It is obvious that except the aforesaid material, there appears to be nothing against the petitioner. So far as, criminal antecedent of the petitioner is concerned, it is obvious from perusal of para-3 to this petition that two cases had been instituted against the petitioner prior to institution of the present case but

Patna High Court Cr.Misc. No.26439 of 2014 (3) dt.09-01-2015 2/2 explanation on behalf of the petitioner is that the aforesaid cases had been registered due to enmity and family dispute. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Rajapakar P.S.Case No. 11 of 2014.
