16-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Sonbarsa P.S. Case No. 101 of 2021, registered for the offence under Section 414 of the I.P.C. and Section 21(a) of the N.D.P.S. Act. As per prosecution case, petitioner was apprehended with one bottle of codeine cough syrup and on his disclosure, 29 bottles of codeine cough syrup was recovered from the shop of co-accused Bharat Kumar.

It is submitted on behalf of petitioner that petitioner had purchased the cough syrup from the shop of co-accused. Petitioner has got clean antecedent and he is in custody since 15.04.2021. Investigation is complete.

Patna High Court CR. MISC. No.41510 of 2021(2) dt.16-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Sitamarhi / concerned court in connection with Sonbarsa P.S. Case No. 101 of 2021.
