JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-08-2024 The present writ petition has been filed seeking the following relief:- "1. That this writ application has been filed for issuance of a writ in the nature of Mandamus to command the respondents to not demolish any construction of the petitioner which are standing on survey plot no. 1415 and 1416, 1093, 1096 and 1099, situated in Mohalla Chak Kalyan(Nalapar) under new ward no.
62, Sheet no. 235/236 circle no. 163 P.S. Chowk, District-Patna without
Patna High Court CWJC No.8743 of 2015(3) dt.14-08-2024 2/2 following the procedure established under land acquisition Act."

At the outset, the learned counsels for the respondents unanimously submit that since the land of the petitioner in question has not been acquired, no direction has been issued by the respondents to demolish any construction made over the aforesaid land of the petitioner, hence the present writ petition has been rendered infructuous.

While taking note of the aforesaid submission made by the learned counsel for the respondents, I deem it fit and proper to dispose of the present writ petition.
