The petitioner seeks bail in a case instituted for the offences under Section 414 of the Indian Penal Code and 25(1b), 26 and 35 of the Arms Act. Prosecution case, in short, is that one rifle along with and 30 live cartridges is recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.2.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that one rifle along with 30 live cartridges is recovered. The car in question belongs to the
Patna High Court CR. MISC. No.29130 of 2019(3) dt.09-07-2019 2/2 petitioner's father. There is no compliance of Section 100 Cr.P.C. Other co-accused has been granted bail vide order dated 28.6.2019 passed in Cr. Misc. No. 38809 of 2019. On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned learned A.C.J.M. 4th Gaya in connection with Magadh Medical P.S. Case No. 185/18.
