The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 341, 323, 337, 307, 353, 225 of the Indian Penal Code.
The prosecution case, in short, is that when the informant along with police force went to arrest the accused persons, in the meantime 35-40 persons with weapons, stones, bricks assembled and created hindrance and assaulted, causing injury and the accused persons fled away.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no
Patna High Court Cr.Misc. No.63607 of 2018(2) dt.29-10-2018 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused due to mistake of fact. 21 persons named in the F.I.R. Including the petitioners along with 15-20 unknown persons are said to have participated in the alleged occurrence. General and omnibus allegation has been made. No specific overt act has been alleged against the petitioners. Other accused persons have been granted anticipatory bail vide Annexure 2 to the present application. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Lakhisarai in connection with Chanan P.S. case No.06 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
