2. The petitioner is seeking regular bail in connection with Surajgarha (Kajra) P.S. Case No. 144 of 2009 for the offences punishable under Sections 17/18 of the C.L.A. Act.

3. As per allegation, the police got an information that some Maoists have assembled in the house of the petitioner with an intention to disturb the election. The police raided the house of the petitioner and apprehended two persons namely Dinesh Ram and Sanjeet Kumar from his house. Some police uniforms, shoe, belt rifle etc. were recovered from house of the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that he was an employee in eastern railway and he was not aware with the existence of this case. He has also submitted that though the petitioner was also falsely implicated in another case but he has been acquitted in

Patna High Court CR. MISC. No.36724 of 2024(4) dt.19-09-2024 2/2 that case, which shows his innocence. The petitioner is under custody since 07.02.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Lakhisarai in connection with Surajgarha (Kajra) P.S. Case No. 144 of 2009, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. The petitioner shall cooperate in the disposal of the trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates, without any reason or unavoidable circumstances, the learned court below shall be at liberty to cancel his bail bond.
