2. The petitioner has preferred this application for grant of regular bail in connection with Lakho P.S. Case No. 183 of 2024 dated 22.11.2024 registered for the offences punishable u/ss 126(2), 115(2), 117(2), 109(1) read with Section 3(5) of the B.N.S and Section 27 of the Arms Act.

As per the prosecution case, when the informant was going to purchase fodder near his house then the petitioner and the co-accused persons surrounded him and assaulted him with lathi, khanti and kudal due to which he sustained injury on his head. When his brother came to rescue him, they also assaulted him and due to assault, he sustained

Patna High Court CR. MISC. No.30575 of 2025(2) dt.13-05-2025 2/3 injury on his hand. It is further alleged that the petitioner ordered them to kill him and after making firing, they managed to escape.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. It is further submitted that there is no specific allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. There is a case and counter case between the parties. As per the injury report, the informant sustained injury is stated to be grievous in nature whereas the informant's brother sustained injuries, one injury is grievous and the other injuries are simple in nature. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.03.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty

Patna High Court CR. MISC. No.30575 of 2025(2) dt.13-05-2025 3/3 Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Lakho P.S. Case No. 183 of 2024.
