1. The present Miscellaneous application has been filed for setting aside the order dated 21.04.2022 passed by the court of learned Sub Ordinate Judge-XIV, Patna whereby and whereunder the petition dated 24.06.2019 filed by the defendant-respondent for recalling the order dated 21.01.2018 passed by the learned trial court whereby the defendant was debarred from filing the Written Statement, has been allowed at the cost of Rs. 1,500/-.

2. Heard the parties.

3. During course of argument, learned counsel for the petitioner/plaintiff submits that the present suit has been filed in

Patna High Court C.Misc. No.369 of 2022(5) dt.21-08-2025 2/2 the year 2015 vide Money Suit No. 146/2015 and till today it is pending for proper and complete adjudication of the case.

4. The learned lawyer appearing on behalf of the respondent/defendant submits that for proper and complete adjudication of this case written statement is highly essential to decide the case, and due to some problem in the family, he could not file his written statement in time and some delay has been caused in filing written statement. He further submits that after considering all the above facts his written statement has been accepted by the trial court after recalling the order dated 21.01.2018. So the impugned order dated 21.04.2022 is upheld with direction to the learned trial court to expedite the case and conclude the trial preferably within one year since the Money Suit is pending from the year 2015.

5. Both the parties are directed to cooperate in the trial.

6. In view thereof, the Miscellaneous application stands disposed of.
