2. The petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

3. As per the prosecution case, on gun point, the accused persons looted the informant and relieved him of his mobile and cash. It is further alleged that they had also looted pick-up van.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired in the present case during course of investigation on the basis of confessional statement of co-accused person. No looted article was recovered from conscious possession of this

Similarly situated co-accused person, namely Rohit Kumar, has already been granted bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 23.11.2023 passed in Cr. Misc. No. 73247 of 2023. Moreover, charge-sheet has already been submitted and petitioner is in custody since 24.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation, fact that no looted article has been recovered from conscious possession of this petitioner, period of custody and claim based on parity, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge XI, Bhagalpur in connection with Sabour P.S. Case No. 250 of 2023.
