The learned Special Public Prosecutor (Mines) has referred to paragraph 7 of the counter affidavit in consonance with the prayer so made on behalf of the petitioner under paragraph 1(i) of the petition and submitted that in the aforesaid background this petition might have become infructuous, whereupon, there happens to be absence of learned counsel for the petitioner.
