Patna High Court CWJC No.8855 of 2015(5) dt.24-10-2024 2/3 illegal encroachment from the plots which was acquired by the State Government of Bihar for rehabilitation of the displaced persons from Pakistan vide Land Acquisition Case No.05/1951-52 and the State Government of Bihar allotted the acquired lands in favour of the Panjabi Refugees.

II. For issuance of order/orders, direction/directions, writ/writs for commanding the respondent authorities to remove the illegal encroachment made over the land bearing Mauza-Dhirachak, Khata no. 357, Khesara no. 1909, area-30 decimals, Jamabandi no.518 and Khata no.335, Khesara no.1910, area-39 decimals, Jamabandi no.518, on which the private respondent is trying to erect a wall by encroaching the aforesaid land.

For issuance of an appropriate writ or order/orders or direction/directions or writ in the nature of mandamus commanding the respondents to remove any encroachment made over the plots, which were acquired by way of the aforesaid land acquisition proceedings and finally allotted by the State Government of Bihar to the Punjabi Refugees."

2. At the outset, the learned counsel for the petitioner submits that one encroachment case bearing Encroachment Case No.09 of 1998-99 is pending consideration before the Circle Officer, Patna Sadar, hence the petitioner be granted liberty to approach him for redressal of his subsisting grievance, if any. Liberty so sought is granted.
