JUSTICE RAJESH KUMAR VERMA ORAL ORDER 14-05-2025 Heard Mr. Manoj Kumar, learned counsel for the petitioner, Mr. Bijendra Prasad Singh, learned counsel appearing on behalf of the informant as well as Mr. Harendra Prasad, learned APP for the State.
2. The petitioner is apprehending his arrest in connection with Hulasganj P.S. Case No. 357 of 2024, F.I.R. dated 16.12.2024 for the offences punishable under Sections 103(1) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. According to prosecution case, this petitioner along with four other accused persons armed with deadly weapons came on tractor and intentionally runs over the tractor on the informant's wife resulting into her death.
4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that although there is specific
Patna High Court CR. MISC. No.30593 of 2025(2) dt.14-05-2025 2/2 allegation against the petitioner in the F.I.R but the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R.

Learned counsel appearing on behalf of the informant as well as learned Additional Public Prosecutor have vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R it appears that there is direct and specific allegation against the petitioner that he has crossed the tractor over the body of the deceased due to which she died and the postmortem report also supports the allegation as alleged in the F.I.R. Apart from that the petitioner carries one criminal antecedent other than the present one.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Hulasganj P.S. Case No. 357 of 2024 pending in the court of Chief Judicial Magistrate, Jehanabad.
7. Prayer is refused.
