JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Gareyakothi P.S. Case No. 105 of 2018 registered for the offences punishable under sections 30(a) and 41(1) of Bihar Excise Prohibition Act, 2016.
The informant got secret information that petitioner and others were carrying Indian made foreign liquor in a vehicle. Subsequently, the informant along with other police officials intercepted the said vehicle and arrested two persons whereas petitioner and other four persons managed to escape from there. Patna High Court Cr.Misc. No.57205 of 2018 (2) dt.20-09-2018 2/2 accused disclosed the name of the petitioner but admittedly, the seized liquor belongs to the F.I.R named accused Satyendra Singh.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that petitioner does not have any criminal antecedent which is evident from perusal of Para-3 of the petition, let petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge, Excise, Siwan in Goreakothi P.S. Case No. 105 of 2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
