JUSTICE MADHURESH PRASAD ORAL ORDER 11-09-2019 The petitioner's specific claim is against the order of punishment of warning and withholding of two increments with cumulative effect dated 26.09.2007, he has preferred an appeal before the Director, Agriculture Department, Bihar, Patna (Annexure-4).
The petitioner's counsel submits that till date no decision has been taken by the Appellate Authority on the said appeal though it was submitted on 29.03.2010. Counter affidavit filed by the State does not deal with the specific assertions to this extent made by the petitioner in paragraph 15 of the writ petition. The submission of petitioner's counsel is that the Appellate Authority should dispose of the petitioner's appeal.
In view of the limited submission, the instant proceedings need not be kept pending.
Patna High Court CWJC No.8977 of 2015(3) dt.11-09-2019 2/2 In the circumstances, petitioner's counsel is permitted to implead the Appellate Authority, namely, The Secretary, Agricultural Department, Bihar, Patna as respondent no. 8 to the instant proceedings.
The writ petition is disposed of. The respondent no. 8 will be obliged to consider the petitioner's claim and dispose of the appeal without any undue delay if the same has not been disposed of till date.
