Mr.Ajay Mishra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-05-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody in connection with Madanpur P.S. Case No. 125 of 2018 for the offences under Sections 409, 420, 406/34 of the Indian Penal Code. The prosecution case is that the instant case was registered on account of misappropriation of amount of Kasturba Gandhi Balika Awasiya Vidyalaya, Madanpur. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 02.04.2019. He further submits that petitioner is only to give direction and to monitor the functioning of the school and he directly did neither receive any amount spent the same as the money allotted for expenditure was used to be by the warden of the school.

No.29557 of 2019(2) dt.03-05-2019 2/2 Learned counsel further submits that at the relevant time petitioner was put on suspension but considering his innocence his suspension was revoked by the department. He further submits that the Accountant and the Warden have been granted anticipatory bail by this Court in Criminal Misc. No.39490 of 2018 and 40003 of 2018, vide order dated 03.08.2018.

Considering the aforesaid facts, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S. Case No. 125 of 2018.
