JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-09-2020 Heard learned counsel for the petitioner and the learned Assistant Counsel to learned Advocate General, Bihar through virtual court proceedings.

The petitioner has approached this Court for transfer of her husband and nephew on humanitarian ground from Bhagalpur Central Jail to Gopalganj District Jail or Motihari Central Jail or Beur Central Jail where there is no COVID-19 threat perception.

Learned counsel for the State submits that the petitioner may be directed to file a representation before

Patna High Court CR. WJC No.368 of 2020(2) dt.28-09-2020 2/2 respondent no.4, the Inspector General of Prison, Bihar, Patna, which shall be disposed of on its own merit.

In my view, no useful purpose would be served in keeping this writ application pending.

Accordingly, this writ application is disposed of with a direction to the petitioner to file a representation before respondent no.4 and the respondent no.4 is directed to fix a date of hearing on the representation of the petitioner, after prior information to him, and pass an order in accordance with law within a period of one month from today.
