The petitioner apprehends his arrest in Complaint Case No.780 of 2017 registered under Sections 323, 498A, 379 and 494 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act in which cognizance has been taken only under Section 498A of the I.P.C.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner is ready to pay Rs.1,500/- per month to his wife (opposite party no.2). In support thereof, a supplementary affidavit has been filed.
Having considered the above facts and circumstances
Patna High Court CR. MISC. No.41374 of 2021(6) dt.09-05-2022 2/2 of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Additional Chief Judicial Magistrate III, Gaya in connection with Complaint Case No.780 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
