The State represented by Dr. Indiwar Kumari, learned APP. This is an application seeking quashing of the F.I.R of Jagdishpur P.S. Case No. 261 of 2014 dated 02.09.2014 instituted for the offence under Sections 409, 420 and 34 of the Indian Penal Code. On 21.03.2018, a bench of this Court had called for a report from the concerned Trial Court with regard to stage of the case.
The report has since been received. The report which is dated 09.04.2018 indicates that in this case final form as mistake of fact has been submitted against the accused persons. Notice had been issued to the informant and the service report of the notice also has been received. In that view of the matter, this petition has become infructuous.
