The petitioners seek bail in anticipation of their arrest in connection with Rajauli P.S. Case No. 150 of 2020, dated 18.04.2020, instituted for the offences under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.
Patna High Court CR. MISC. No.30397 of 2020(2) dt.18-12-2020 2/3 It appears from the prosecution report that there has been a recovery of 320 litres of liquor from a car, bearing Registration No. JH10V-2536.
It has been submitted on behalf of the petitioners that they do not own the aforesaid car nor are they in any way connected with the liquor. In fact, they have been named by the local Chowkidar as having been spotted fleeing away from the place where the raid was conducted.
The petitioners, it has been urged, have been made accused in this case only because of village politics and enmity.
The petitioners do not have criminal antecedents.
Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each
