This application for anticipatory bail arises out of Delha P.S. Case No. 57 of 2016 for the offence punishable under Sections 419 and 420/34 of the Indian Penal Code and Section 10 of the Bihar Control of Examination Act, 1981. Allegedly, the petitioner had made someone else to appear in the secondary examination of the Bihar School Examination Board in his place, who was apprehended in course of invigilation.

It is submitted on behalf of the petitioner that now the charge sheet has been submitted and in course of investigation the petitioner has cooperated with the police after having been given benefit under Section 41A of the Cr.P.C. Considering the nature or accusation and facts and circumstances as stated above, this application is allowed.

No.29342 of 2019(2) dt.03-05-2019 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-7th, Gaya, in Delha P.S. Case No. 57 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
