The petitioner apprehends his arrest in Majhaulia P.S. Case No.458 of 2019 registered under Sections 467, 468, 471, 420, 406 and 34 of the Indian Penal Code.
The informant alleged that the petitioner purchased the land from her grand-daughter with an intention to grab the land and dispossess the informant.
Learned counsel for the petitioner submits that the petitioner purchased the land from Tanu Sharma (granddaughter of the informant). Sarita Devi (mother of the vendor) died in the year 2001. The informant had no male issue and that is why the daughter of the informant got half share in the land. It is further submitted that the petitioner will not dispossess the informant from the land during the pendency of the case.

No.30860 of 2020(2) dt.17-12-2020 2/2 Taking into consideration the facts that the petitioner has undertaken not to dispossess the old lady (informant) from the land which was inherited from her husband, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No.458 of 2019, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
