2. The petitioners are apprehending their arrest in a case in connection with Ghanshayampur P.S. Case No. 216 of 2023 registered for the offences punishable under Section 376/34 of the I.P.C. and Section 3/4 of the Dowry Prohibition Act.
3. As per the prosecution case, co-accused Md. Sadre Alam on the false pretext of marriage has committed rape on the informant's daughter and it has been further alleged that the
Patna High Court CR. MISC. No.32897 of 2026(2) dt.13-05-2026 2/3 family members of Md. Sadre Alam demanded Rs. 3 Lakhs and a motorcycle as dowry and further stated that if the demand is not met the marriage would not be performed.
4. Learned counsel for the petitioners has submitted that the allegation of physical relationship on false pretext of marriage is against co-accused Md. Sadre Alam and the said coaccused Sadre Alam has been granted the privilege of anticipatory bail by the co-ordinate Bench of this Court by order dated 03.07.2024 passed in Cr. Misc. No. 36419 of 2024. It has further been submitted that at best a case under Section 3 and 4 of the Dowry Prohibition Act is made out against the petitioner which is bailable in nature. It has further been submitted that coaccused Sadre Alam has performed marriage with the daughter of the informant/victim and after such marriage the parties have filed a joint petition in the court below.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.

Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten thousand) each with two sureties of the
Patna High Court CR. MISC. No.32897 of 2026(2) dt.13-05-2026 3/3 like amount each to the satisfaction of the learned court concerned, in connection with Ghanshayampur P.S. Case No. 216 of 2023, subject to conditions as laid down under section 482(2) of the B.N.S.S.
7. The application stands allowed.
