Petitioner apprehends his arrest in Rahui P.S. Case No.56 of 2019, registered under Section 30(a) and 32(c) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that of course recovery of 46 litres of country made liquor is made from the house of the petitioner but the petitioner is residing in Kolkata. Somebody might have kept liquor for doing mischief and on such recovery was made but from perusal of the FIR and the seizure list it appears that the recovery of 46 litres country made liquor is made from the house of the petitioner. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
