====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-01-2021 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in a case registered for the offence punishable under Sections 366(A) of the Indian Penal Code.
Prosecution case as lodged by the informant is that his daughter Shobha Kumari aged about 15 years went market for purchasing some article but did not return back. It is alleged that the accused persons have taken away his daughter with bad intention. The informant has suspicion that the accused persons shall either sell his daughter or disappear the dead body of his daughter after killing her.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this

He submits that co-accused Ashok Kumar who is the son of the petitioner and Shobha Kumari daughter of the informant was in love affair with each other and both of them on their sweet will have went away elsewhere. He submits that petitioner is the father of the co-accused Ashok Kumar. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 21.03.2020.
In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Paroo P.S. Case No. 279 of 2019 pending before the court of the learned Additional Chief Judicial Magistrate-III (West)-cum-Sub Judge-III, Muzaffarpur. Accordingly, the application is dismissed.
However, petitioner is at liberty to renew his prayer for bail after framing of charge.
