Mr.Sanjay Kumar Tiwary ====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 20-05-2025 Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner makes a prayer for bail in connection with Paroo P.S Case No.293 of 2024 registered for offences under Sections 126(2), 115(2), 109, 118(1), 352, 351(2) and 8(3) of the B.N.S.

3. The allegation in the First Information Report is that the petitioner, who happens to be the son of the informant had demanded Rs. 300 for consuming liquor and on refusal of the same, he assaulted his own father i.e. the informant by

Patna High Court CR. MISC. No.32561 of 2025(2) dt.20-05-2025 2/3 means of a daab on his head due to which the informant got injured.

4. Learned counsel for the petitioner submits that the First Information Report itself would indicate that no case under Section 109 of the B.N.S. would be applicable in the present case as the matter arises out of a simple dispute with regard to demand of Rs. 300. Further, it has also been pointed out that the matter has been compromised between the parties due to intervention of well-wishers and a compromise petition has been brought on record by way of Annexure-2 series. The petitioner is in custody since 04.09.2024 and has no criminal antecedent. So far as the injury report is concerned, the opinion on the same has been reserved.

5. Learned APP for the State opposes the prayer for bail application.

6. Taking into consideration that the informant and the petitioner are father and son and they have compromised the matter amongst themselves, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional Session Judge-V, Muzaffarpur, in connection with Paroo P.S Case No.293 of 2024, subject to

Patna High Court CR. MISC. No.32561 of 2025(2) dt.20-05-2025 3/3 the condition that the petitioner shall co-operate in the investigation/trial.
