The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.
Allegation is that six unknown miscreants on the point of fire arm took away Rs.3,43,649/- and other official documents, mobile etc.
It has been submitted on behalf of the petitioner that the petitioner is in custody 22.11.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. His name has come in course of investigation. Rs.28,000/- is alleged to have been recovered
Patna High Court CR. MISC. No.31169 of 2019(2) dt.10-05-2019 2/2 from the house of the petitioner. Said amount belonged to the petitioner. Neither the amount in question has been put on T.I.P nor the petitioner has been put on T.I.P. It is further submitted that the petitioner may be released after completion of nine months in custody in the present case from 22.11.2018. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. The petitioner has criminal cases pending against him.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of nine months in custody in the present case from 22.11.2018 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Raniganj P.S. case No.296 of 2018.
