The petitioner seeks bail in Raxaul P.S. Case No. 47/2017, instituted for offence under Section(s) 20, 22, 23 and 24 of the NDPS Act.

It is alleged in the written report that on getting secret information, raid was conducted in a bus bearing Registration No. BR43 P 1183. On search total 1.800kg Charas was recovered from aforesaid bus, which was being transported by this petitioner.

Learned counsel for the petitioner has submitted that petitioner is in custody since 07.03.2017.

Report from the court below regarding present stage of trial has been received, wherein it is mentioned that seven out

Patna High Court CR. MISC. No.31020 of 2019(3) dt.02-07-2019 2/2 of nine witnesses have already been examined. This Court finds that trial has sufficiently progressed. Therefore, this Court is not inclined to grant bail to petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.

The trial court is directed to expedite the trial and conclude the same as early as possible positively within a period of six months from the date of receipt of copy of this order. (Sanjay Priya, J) rakhi/- U T
