The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Section 40 of Bihar Minor Minerals Concession Rule, 1972, sub-Section 5(a), 5(c) and 8(a) of Bihar Mineral (Prevention of illegal Mining, Transportation and Storage) Rule, 2003.

The petitioner is an owner of the tractor which was carrying sand after illegal mining. The driver of the tractor was apprehended on the spot. Petitioner has stated on oath that he has got no criminal antecedent and he had no knowledge about the sand in his tractor.

No.59555 of 2018(2) dt.01-11-2018 2/2 Hence, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Durgawati Police Station Case No.173 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
