JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-01-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. This is the fourth attempt of the petitioner to obtain bail in connection with S.Tr.No.390 of 2016 arising out of Sahpur P.S. Case No.48 of 2016 registered for the offences under Sections 147, 148, 149, 341, 324, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act. Lastly the prayer for bail of the petitioner was rejected vide order dated 17.11.2021 in Cr.Misc.No.56010 of 2021 with a direction to the learned court below to conclude the trial as early as possible.

Learned APP for the State and learned counsel for the informant have jointly opposed the prayer for bail of the

Patna High Court CR. MISC. No.32380 of 2022(5) dt.18-01-2023 2/2 petitioner.

Having regard to the facts and circumstances of the case wherein this Court has been informed that the evidences of the prosecution and the defence have already been closed and the case is fixed for hearing in the learned trial court, this Court is not inclined to release the petitioner on bail. Let the learned trial court hear the matter and conclude it within a reasonable period.
