JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2020 Heard Mr. Hemant Kumar, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Bikram P.S. Case No. 134 of 2019 dated 09.05.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It has been urged on behalf of the petitioner that the vehicle from which the liquor was recovered belongs to his wife. It has further been submitted that according to the prosecution report itself, it would appear that many persons, on seeing the police party removing the encroachment, lef their vehicles and went to see the operation of the police. In

Patna High Court CR. MISC. No.30318 of 2020(2) dt.17-12-2020 2/2 that connection, the vehicle which is registered in the name of the wife of the petitioner has been seized from where there is recovery of liquor.

Be that as it may, considering the fact that the petitioner was earlier made accused in a case of similar nature, I am not inclined to grant anticipatory bail to him. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the Court below and seeks bail, his petition shall be considered on its own merits without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
